This Candidate Privacy Notice sets out how your personal information as a job applicant will be handled and protected by King and its group companies (Activision Blizzard Inc and its affiliates) collectively described as “King”, “we”, “us” or “our”).

We appreciate your interest in King, our products and services, and we take care to process and use your personal information responsibly.

Scope of this Privacy Notice


This Candidate Privacy Notice applies only when your information is submitted through our Website or other job application methods to apply for a position with King. If your application is successful, you will be provided with King’s Employee Privacy Policy, which will apply to the processing of your personal information as an employee at King in the European Economic Area (EEA), the United Kingdom (UK) and the United States. Please note this Privacy Notice does not apply to the use of King Products and Services (“King Services”). By using any King Services, including this Website, you are subject to the King Privacy Policy, located here.

What information does King process?

  • To apply for a role, you will need an applicant account on our Website. We ask that you provide us with some personal information, including your name, mailing address, postal code, e-mail address, telephone number, and other information which is necessary for the purposes set out above.
  • You may send us your CV, résumé, and/or other relevant documents, which may include work history, qualifications, compensation, and personal skills.
  • If we ask you to provide references, it is your responsibility to obtain consent from your referees before providing their personal information to King.
  • We will process the information you provide to us during the interview process, including any assessments and third-party assessments.
  • We may require additional information for the specific purpose of background checks. We will only collect this information after giving you notice of the background check process and obtaining your consent. A background check will only be carried out where it is permitted or required by law.
  • We may collect additional information from third parties who are lawfully entitled to share your Information with us.

Purpose of Processing: Why does King process my information?


King collects your personal data for the purposes of managing King’s recruitment related activities as well as for organisational planning purposes globally. Consequently, King may use your personal data in relation to accepting, evaluating and selecting applicants submissions for job postings, including for example setting up and conducting interviews and tests; identifying potential applicants; conducting background check, where permitted by and in accordance to the applicable law; communicating with you (e.g. providing information regarding potential interview dates and notification with regards to the recruitment process); evaluating and assessing the results; preparing applicant’s information and as otherwise needed in the recruitment processes, including, if applicable, hiring; keeping records related to our hiring practices for use in future recruitment activities and to ensure compliance with the local laws; complying with legal and regulatory obligations; responding to a warrant subpoena or other valid legal process; complying with other legal obligations, including verifying that you are legally permitted to work in the country where you are applying and resolving disputes and/or as part of a legal defense, if necessary. In each case where we process your information, we do so lawfully in accordance with the legitimate interest legal basis set out under European data protection law.

Information collected from third parties (vendors and affiliates)


King may merge the personal information collected from the Website with data from third parties where such information is either (a) publicly available or (b) was lawfully shared with us by the 3rd party in order to update your overall information. These third parties may include employment agencies, references, former employers, or other sources that provide employment related information and services for recruiting or other purposes as described in this policy.

Who does King share my information with?


Access to your personal information will be restricted to the members of the King’s staff involved in the recruiting process, hiring managers and designated agents who have a need to know the specific information in question, in order to carry out their responsibilities with regard to recruitment or applicable law.

King does not disclose your personal data to unauthorised third parties. However, as a global corporation consisting of multiple affiliated companies in various countries, King has international sites and uses resources located throughout the world. King may from time to time also use third parties to act on King’s behalf, such as the company Workday, which hosts this Website. In those cases there will be a written contract between King and the vendor. The vendor must agree to reasonable levels of security regarding your data and the vendor will not be permitted to use your data except as required for the performance of those services for King. You understand that, for the purposes as set out in this Privacy Notice, your personal data may be transferred and/or disclosed to any company within King’s group of companies as well as to third parties acting on King’s behalf. Upon request or pursuant to our legal obligations, your information may also be disclosed to governmental entities in compliance with applicable laws, such as to those agencies authorised to review and enforce equal opportunity laws.

We will transfer your information to affiliated entities or third parties to jurisdictions outside the EEA and in particular to the USA. Please note that these countries outside of the EEA may not have the same data protection laws as your own jurisdiction. We take steps to ensure that there are adequate safeguards and mechanisms in place (including the use of EU model clauses) to allow the transfer of your information across borders outside of the EEA.

What are our employment disclosures?


All open jobs offered by the Company are subject to specific job skill requirements. The job skill requirements, qualifications and preferred experience are determined by the office offering the position.

The Company is an equal opportunity employer, and all hiring decisions are subject to relevant employment laws and regulations, including immigration laws pertaining to work authorization requirements and any other applicable government permissions or compliance. In some locations, to comply with applicable legal requirements the Company will disclose candidate personal data to government agencies.

If for any reason you wish to view, correct, update or delete your personal information, simply access your applicant account and edit and/or delete your information as necessary. You will need your credentials to access your applicant account.

Depending on your local laws, you may have the right to request to access, update, or delete your personal information.

For candidates in the United States, if you are a resident of California, please see the section For Candidates who are California Residents.

For candidates in the European Economic Area and the UK: You have some rights in relation to your personal information, such as the right to request access to the personal information King and its processors process about you, to request that King restricts processing of your personal information, and to request that King erase your personal information, subject to limitations. You also have the right to lodge a complaint with the applicable data supervisory authority in your country. Please see the section for Candidates in the European Economic Area (“EEA”)

However, we may still retain some personal information to comply with legal and regulatory requirements and to resolve disputes; in which case, your personal information will not be used for any other purpose.

Retention


If you are successful in your current application to King, the information you provide as set out in this Privacy Notice will be retained as part of your employee file where necessary, subject to our Employee Privacy Policy.

If you are unsuccessful, we will keep your information for no more than three years so that we can contact you about current and future positions at King. If you do not want your information to be retained, please let us know at [email protected]. Please note that we may still retain some information to comply with legal and regulatory requirements and to resolve disputes; in this case, your personal information will not be used for any other purpose.

Security Measures


The Company has implemented a range of physical, administrative, and technical measures designed to protect your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. In addition, we request that service providers who process personal information on our behalf adopt a range of security measures designed to help protect your Information.

Confidentiality


During the course of the recruitment process, it may be necessary for King to disclose confidential information to you in order to evaluate your suitability for the position you have applied for. All information that is shared with you by King in the recruitment process and which is not already in the public domain is confidential and you agree to treat it as confidential. You will not use or disclose such confidential information to any person, company or other entity.

Please do not, at any stage in the recruitment process, bring or send anything to King that is proprietary to a third party and/or has not been made publicly available (including code, artwork, ideas etc), is in beta, is a trade secret or is otherwise commercially-sensitive information of another company. If you do so, contrary to this requirement, King takes no responsibility for any materials or ideas so provided.

Notice to Candidates Who Are Residents of California


The California Consumer Privacy Act (“CCPA”) provides California residents, referred to in the law as “consumers,” with rights to receive certain disclosures regarding the collection, use, and sharing of personal information, as well as rights to access and control personal information.     • Inferences about you (e.g., interview notes, skill test results), collected from you or generated by us as you proceed through the application process.

We do not sell or share (for targeted advertising) personal information collected from or about applicants through the application process. We determine the retention period for each of the categories of personal information listed above based on (1) the length of time we need to retain the information to achieve the business or commercial purpose for which it was obtained, (2) any legal or regulatory requirements applicable to such information, (3) internal operational needs, and (4) any need for the information based on any actual or anticipated investigation or litigation.

  • Right to request access to your personal information: You have the right to request, up to two times in a 12-month period, access to the personal information we have collected about you and information regarding the source of that personal information, the purposes for which we collect it, and the third parties and service providers to whom we sell, share, or disclose it. Please note that certain information may be exempt from such requests under law.
  • Right to request correction of your personal information: You have the right to request that, in certain circumstances, we correct personal information that we have collected about you. Some information may be exempt from such requests under law.

Notice to Candidates in the European Economic Area (“EEA”) and UK


Whether you are applying from the UK or from within the EEA the data controller for your personal information is King.com Ltd.

  • Legal basis for processing your personal information: When applying to a position at the Company, you submit your application on a voluntary basis and you consent to share your personal information with us for processing, storage and transfer for the purposes stated in this Privacy Policy. When we don’t collect personal information directly from you, we process this information based on our legitimate interest in evaluating your candidacy, processing your application, ensuring that our organization is properly and adequately staffed, and that we can meet our business needs. We also process your personal information for compliance with legal obligations that apply to us.
  • Retaining your personal information: We will keep your personal information for as long as necessary for the hiring process from your last contact with King, including for the purpose of evaluating your candidacy, notifying you about job opportunities, and for satisfying any legal or reporting requirements.
  • Data Protection Rights: Candidates who are residents in the EEA or the UK have a number of rights. If you are an Applicant who is a resident of the EEA or the UK, you may request to access or delete your Personal Information. You can also object to the processing of your personal information. We will examine your request and provide you with a decision.

As you are giving your consent by submitting your information in order to process your application and therefore your Personal Information related to this application, you have the right to withdraw such consent to further use of your Personal Information at any time.
